Please read this information carefully. The settlement Class consists of private insurers, employee welfare benefit plans, union health and welfare funds, employer-sponsored health plans, and other third-party payors ("TPPs") that reimbursed, purchased, or paid for Paxil® (in both tablet and suspended form) and Paxil CR® prescribed to persons under 18 years of age, from January 1, 1998 through December 31, 2004.

Final Approval Hearing

The Court will hold a Final Approval Hearing on September 30, 2008 at 9:00 a.m., at the United States District Court for the District of Minnesota, 300 South 4th Street, Minneapolis, MN 55415, to consider whether the settlement is fair, reasonable, and adequate. At the Hearing, the Court will decide whether to approve the settlement and the motion for attorney's fees and expenses.

The Lawsuits and Terms of the Settlement

Plaintiffs allege that Paxil® has not been shown to be safe and effective for persons under the age of 18. Defendant GSK denies these claims and any liability. To avoid the cost and risks of further litigation, both sides have agreed to a settlement. GSK has agreed to pay $40 million to settle the claims set forth in Plaintiffs' lawsuits. After attorney's fees and the costs of administering the settlement are deducted from the $40 million, the balance will be distributed on a pro rata basis to Class members who qualify and submit a claim. If there is any money left over after all claims are paid, the balance will be donated to a charity involved with children's mental health issues.

Your Legal Rights and Options in this Settlement

If you are a Class member, you have the following options:

  • Submit a Claim Form: If you wish to share in the Settlement Amount, you must send a properly executed Claim Form to the Settlement Administrator by first class mail postmarked on or before December 12, 2008. Follow the instructions in the Notice at the link on the left and refer to Question 8. If you submit a valid Claim Form, you will be bound by the terms of the settlement. If your Claim is deemed eligible by the Court, you will be entitled to a pro rata share of the Settlement Amount.

  • Exclude Yourself: The Exclusion Deadline has passed. Exclusions had to be postmarked on or before August 1, 2008. Therefore you may no longer file a Request for Exclusion.

  • Object: The Objection Deadline has passed. Objections needed to be filed with the Court on or before August 1, 2008 (with copies sent to Class Counsel and Counsel for GSK). Therefore, you may no longer file an Objection.
